What You’ll Get to Do:
Assist the staff of the Special Operations Unit of the Office of Enforcement Operations of the Criminal Division of the U.S. Department of Justice with:
Process requests made by federal prosecutors and law enforcement authorities for the issuance of an S visa to persons who have substantially assisted law enforcement in a criminal case:
Ensure that all S-Visa request submitted by law enforcement have been properly logged in.
Review S-visa requests to ensure that all statutory and department policy mandated information has been provided by law enforcement.
Identify the grounds of inadmissibility under immigration law that apply to the particular defendant for whom a S visa application is made.
Contact the sponsoring law enforcement agency to identify all the relevant facts of the person’s cooperation with the law enforcement, underlying criminal conduct (if any), and basis for inadmissibility.
Write a memorandum for the signature of the OEO Director, to the Deputy Assistant Attorney General, making a recommendation regarding the request.
Prepare congressional reports regarding S visas:
Engage with CIS to positively identify all cases where S visas were granted in a particular year
Review the OEO file corresponding to each such S visa granted to determine what documentation is missing
Engage with the sponsoring federal law enforcement agency to obtain the information that is missing, if any
Draft the congressional report once all the information has been obtained.
